Struggling Sendy Put Under Administration

Sendy, a Kenyan logistics firm has been put under administration after failing to get a buyer. The group’s affiliates have been put under Peter Kahi of PKF Consulting (K) Limited adminstration effective September 20, 2023.

The companies Sendy Kenya Freight Limited (company number PVT-Q7UDVX5), Sendy Limited (company number CPR/2014/140428), Sendy Store Limited (company number PVT-PIUQRL9), and Sendy Kenya Marketplace Limited (company number PVT-MKUJX57) are part of Sendy Group which ran out of cash to run its operations.

Founded in 2015 by Meshack Alloys, Evanson Biwott, Don Okoth, and Malaika Judd, the logistics startups bringing together and connecting trucks, delivery vans and motorcycle riders to delivery jobs and fulfillment centers digitally hoped to make money out of the transport business serving digital commerce platforms.

Last year, Sendy fired 20% of it workforce due to bad economic conditions and funding challenges. The company said in a statement,that “the move was done in full adherence to applicable laws and industry best practice. All employment and contractual terminal benefits were duly paid to every affected employee. Our staff have always been our biggest asset as a company. We have always valued their diverse talents and, more critically, their welfare. Decisions impacting them are not taken lightly. We will continue to focus on creating solutions for businesses across the continent in line with our mission of empowering people and businesses by making it easier to trade.”

Despite raising over KES 2 billion in funding from firms such as Atlantica Ventures and Toyota Tsusho Corporation and additional funding from MOL PLUS last year, the firm has not been able to survive the post-COVID economic conditions and bad uptake of eCommerce and freight in the country.

African Genomics Startup 54gene Shuts Down After Raising $45 Million

54gene, the pioneering African genomics startup once hailed as a breakthrough for global health equity, has begun winding down operations after raising a total of $45 million from international investors.

Founded in 2019 by Dr. Abasi Ene-Obong, 54gene set out to address a major gap in global medical research: less than 3% of the genetic material used in pharmaceutical studies originates from African populations. The company collected and analyzed genomic data to support drug discovery and precision medicine tailored to Africans — a market long overlooked by biotech.

But after four turbulent years, the company has collapsed under financial and leadership strain.

The shutdown process began in July 2023, with the startup’s website disappearing from the internet by September. The company also lost its PR representation, signaling mounting instability.

54gene underwent three CEO changes in just one year. Silicon Valley biotech executive Ron Chiarello was appointed in March 2023, but exited only four months later.

“Unfortunately, the company could not continue to operate financially, and it began to wind down in July,” said Ron Chiarello, former CEO.

As part of the dissolution, 54gene is now trying to sell its key assets — including a state-of-the-art biobank containing thousands of valuable biological samples.

However, unresolved disputes threaten to slow the asset sale. Creditors claim they remain unpaid, and former legal counsel and interim CEO Teresia Bost has filed a lawsuit accusing the company of discriminatory behavior and a hostile work environment.

According to a statement released by the Data Protection Commissioner’s office on a Tuesday, “Roma School, an Educational Institution based in Uthiru has been fined Ksh 4,550,000 for posting minors’ pictures without parental consent.” This hefty penalty serves as a stern reminder to all educational institutions and entities handling personal data, particularly data concerning minors.

This case highlights the critical need for schools and similar institutions to adhere to the principles and safeguards outlined in the Data Protection Act. In particular, it underscores the essential requirement of obtaining explicit consent from parents or guardians before processing any data related to minors.

Immaculate Kassait, the Data Commissioner, stressed the importance of compliance with the Data Protection Act and the responsibility of data controllers and processors to ensure that personal data processing aligns with the provisions of the Act. She emphasised that failure to comply with the Act would result in the institution of enforcement procedures.

While Roma School’s director acknowledged receiving the letter from the Data Protection Office regarding the fine, he expressed his surprise, stating:

“I don’t understand what is happening because I have not received any complaint from anyone regarding the matter.” Despite this, he expressed his intention to visit the Data Protection Commissioner’s office to further discuss and clarify the situation.

The penalty notices issued to Roma School are based on Sections 62 and 63 of the Data Protection Act, 2019 (Act), and Regulations 20 and 21 of the Data Protection (Complaints Handling Procedure and Enforcement) Regulations, 2021. ODPC imposes fines totaling Sh9M on three businesses for violations of privacy

The Office of the Data Protection Commissioner (OPDC) has today imposed fines totalling Sh9 million on three businesses for violations of data privacy regulations.

In an official announcement, the agency disclosed that the fines were levied against a private school, a digital credit provider and a nightclub, each for distinct breaches.

The private school, Roma School as mentioned by ODPC incurred a Sh4.5 million penalty for the unauthorized posting of a minor’s photos on its social media platforms without parental consent.

Meanwhile, Mulla Pride Ltd, the named digital credit provider faced a Sh3 million fine for utilizing the names and contact information of individuals acquired from third parties.

Additionally, Casa Vera Lounge, the nightclub mentioned by the ODPC, which is located in Ngong, Nairobi, was fined Sh1.9 million for sharing revellers’ images on their social media platforms without obtaining proper consent.

The OPDC emphasized that the fine imposed on the private school was the most substantial ever imposed on an educational institution, serving as a cautionary example to other schools regarding the importance of obtaining consent before sharing personal data.

In a statement, the OPDC explained, “The Office of the Data Protection Commissioner (ODPC) has issued three Penalty Notices to three Data Controllers for failing to respect Data Privacy Rights of Data Subjects and for non-compliance with the Data Protection Act.”

Furthermore, the agency stated that the penalty imposed on the digital credit provider was intended to discourage similar actions in the future.

“This penalty will ensure that digital lenders and financial institutions notify data subjects when collecting and processing their data, along with disclosing the purpose of processing said data,” the statement concluded.

Nithio’s investment, made through its investment vehicle, Nithio FI,  is part of the Productive Use Appliance Financing Facility (PUAFF), which catalyzes the uptake of productive use appliances across Africa. PUAFF is managed by CLASP, an international non-profit organization that improves the energy and environmental performance of appliances and equipment, and Nithio, and supported by the Global Energy Alliance for People and Planet (GEAPP).

Nithio’s investment is part of a $12m syndicated debt facility led by Mirova Sunfunder and financed through its Solar Energy Transformation Fund), Mirova (through its Gigaton strategy) and Triodos Investment Management, which together will enable SunCulture to finance inventory and receivables for its Kenyan subsidiary across its productive-use renewable energy products, related appliances and  irrigation equipment. This will allow SunCulture to reach more customers, especially smallholder farmers who need affordable and reliable access to energy and water for their livelihoods.

Five African startups namely Eden Care from Rwanda, iZola from Kenya: mDoc from Nigeria, Pharmarun from Nigeria and Zuri Health from Kenya have been selected among the 2023 cohort of the Google for Startups Growth Academy: AI for Health after an intensive selection process that started in May.

The five startups from Africa, among the 30 transformative startups from across Europe, Middle East, and Africa will join Google’s Google for Startups Growth Academy: AI for Health, a hybrid program dedicated to supporting high-potential startups using AI technology to grow and innovate responsibly in the healthcare and well-being industry.

The startups will have three months of workshops, mentoring, and networking events, founders develop data-driven strategies for acquiring new customers and partnerships, innovate responsibly with emerging technologies, and expand to new markets.

According to Yuval Passov, Head of Google for Startup and lead of the program: “Africa’s innovative spirit in the AI for Health domain is profoundly inspiring. ICT CS Eliud Owalo Unveils Connected Africa Summit 2024

The Cabinet Secretary for Information, Communications and the Digital Economy, Eliud Owalo has today unveiled the Connected Africa Summit 2024. The Continental Summit will build on the gains of Connected Kenya Summit which has run for the last 12 years under the auspice of the ICT Authority.

The continental summit, scheduled for 2nd – 5th April next year, seeks to drive Africa’s access to ICT and Innovation as it opens up for intra-Africa trade through the African Continental Free Trade Agreement (AfCFTA) focusing on the digital economy. It brings together industry players from the private, public sector, and academia

The agreement, which has so far been ratified by over 47 African Countries, is expected to leverage ICT and the digital economy to boost trade across the continent while creating new opportunities for the continent’s growing youthful population.

Speaking during the Post Connected Summit Breakfast, CS Owalo reaffirmed the Ministry’s support of the event and indicated that the launch was timely and historic for the continent’s digital partnerships, integration and development.

“We were here basically to embark on preparations for the Connected Africa Summit 2024 which we want to host as a country. That will give us an opportunity to showcase the milestones that we have realised in the digital space as a country. As you are aware, the world is now a small global village because of technology. The Connected Summit 2024 will be an opportunity to share ideas as a continent. The Summit will further create a learning platform for Africa in the technology space so that we learn from each other and also embrace the best-case scenarios.” said the CS. 

Noting from the subsequent Connected Summit deliberations, the private and public sector, through partnerships, have managed to fully onboard 9,700 government services on the e-citizen services. Additionally, the Ministry is training youth through the Jitume and Ajira program and will augment the Connected Africa Summit 2024 goals.

Speaking on the country’s connectivity and its impact on the sector’s development, Eng. John Tanui, Principal Secretary, the State Department of ICT and Digital Economy noted that they are accelerating connectivity efforts for enhanced impact on ICT development.

“We are ensuring that every part of the country can be connected. We are working with the private sector to connect internationally through the six submarine cables. On terrestrial, we have connected all the county headquarters and we are ensuring that the broadband through fibre can be enhanced not only through the NOFBI but relying on the fibre.” Eng. Tanui said.

Prof. Edward Kisiang’ani, Principal Secretary, the State Department of Broadcasting and Telecommunications assured stakeholders that the government is committed to driving connectivity through partnerships with the private sector to enhance development.

“The connectivity is being implemented through the government which has so far committed five billion shillings which has been released to help enhance connectivity. We are on course to make it happen through partnerships with the private sector.”

Hon. Sylvanus Maritim, ICT Board Chairman gave an assurance to support the Connected Africa Summit 2024 in looking for financial and partners and the success of the event.

“Connected Summit 2023 was successful and we want to go continental in 2024. ICTA Board has committed to support the event,” he said.

Stanley Kamanguya, CEO of ICT Authority thanked all the partners of 2023 and noted that the Connected Africa Summit 2024 will be a platform to showcase Africa’s ICT developments and connect on the developments.

“We are now scaling the Connected Summit to the continental level because we believe that as a country we have a lot to showcase and we would like to give our private sector partners and local innovators a chance to learn from what other countries are doing.” said Kamanguya.

Under the initiatives initiated by the ICT Authority, the digital economy continues to create opportunities for both employment and wealth creation, Africa must take its place within the wider global economy and we can only do this by developing our capabilities in ICT and Innovation. Cloud communications platform Infobip named Leader in the CPaaS market

Global cloud communications platform Infobip has been named a Leader in the Communications Platform as a Service (CPaaS) market by analyst firm Gartner. In the first Gartner Magic Quadrant for CPaaS, Infobip is recognized as a Leader for its overall completeness of vision and ability to execute.


In its Competitive Landscape CPaaS report, Gartner said: “the communications platform as a service market is evolving beyond APIs to encompass the entire customer journey. Safaricom Faces Legal Showdown Over Alleged IP Infringement: Judge Orders Trial to Proceed

In a recent legal twist, a high court judge has given the green light for a potentially groundbreaking trial involving Safaricom, the Kenyan telecommunications giant.

The case revolves around allegations of intellectual property (IP) infringement, and it has taken an intriguing turn as the court dismissed Safaricom’s bid to halt the proceedings. Kenyan entrepreneur Peter Nthabi Muoki has accused Safaricom of deploying an M-Pesa feature strikingly similar to his own innovation. The High Court judge in charge, Josephine Mong’are, decided that Safaricom must answer these allegations in court. Safaricom had been planning to introduce a new product called ‘Manage Child Account’ via a USSD Code. However, Muoki claims that he had previously shared a remarkably similar product named ‘M-Teen Account’ with Safaricom.

The ‘M-Teen Account’ was designed as an M-Pesa sub-wallet targeting individuals aged 13 to 17 and 18 to 24, with the primary aim of enhancing parental control over their children’s spending habits. Reportedly, this crucial discussion took place in March 2021.

At that time, Safaricom had expressed concerns about potential obstacles to rolling out the feature, with the lack of identification cards among the target demographic being the most significant hurdle. This compelling reason meant that the product required approval from the Central Bank of Kenya.

Muoki was taken aback when he discovered that Safaricom was testing a product that seemed eerily reminiscent of his own creation.

Consequently, he took legal action, seeking to compel Safaricom to produce documents he claims they possess. Among the documents requested is a write-up pertaining to the M-Pesa Parent Child Control product and functionality by Huawei Technologies, shared with Safaricom and others.

Muoki’s initial application was granted, but Safaricom lodged an appeal against the ruling.

Notably, Muoki is seeking compensation for the gains and profits Safaricom derived from the alleged infringement of his IP copyright. Furthermore, he has requested the court mandate Safaricom to pay him royalties and licencing fees. As an alternative to royalties, he is willing to settle for KES 10 billion in compensation for the M-Pesa product.

In response, Safaricom attempted to suspend the case, citing a pending appeal contesting an order requiring the release of various documents, including correspondence with Huawei Technologies (Kenya) Company Limited.

However, this request to postpone the proceedings was rejected by the court.

Concluding her ruling, Judge Josephine Mong’are declared, “In conclusion, I find and hold that the application by the defendant has no merit and is hereby dismissed with costs to the Plaintiff.”

The trial is scheduled to commence on October 31.

This legal battle is not Safaricom’s first encounter with the courtroom, as illustrated by recent events involving Kenyan musician Bamboo, who won a nine-year copyright legal battle against the company. The court ruled in favor of Bamboo, ordering Safaricom to pay him KES 4.5 million for copyright infringement.

The global technology company, specializing in payments for emerging markets, made this announcement during its seventh Payments Summit held in São Paulo, Brazil, from September 18th to 20th.

This strategic expansion extends to eight additional African countries, namely the Ivory Coast, Egypt, Ghana, Morocco, Senegal, Tanzania, Uganda, and Zambia.

EBANX will facilitate local payments for global merchants in these countries, strengthening its presence in Africa and bringing the total number of countries it operates in on the continent to 11, covering Northern, Western, East, and Southern Africa.

In addition to its African expansion, EBANX revealed its plans to further its reach in Latin America and the Caribbean by adding the Bahamas and Jamaica to its portfolio. This move increases its coverage to 17 Latin American countries and 29 worldwide, including the recent inclusion of India.

Watu Credit Partners with ARC Ride to Increase Number of EV Battery Swap Stations in Nairobi

Watu Credit Limited .an asset financing company, has partnered with Battery-as-a-Service provider ARC Ride, bolstered by the incorporation of global auto parts Tier1 company Musashi Seimitsu Industry Co., Ltd to manufacture 1,000 electric vehicles (EV) and establish over 300 battery swap stations in Nairobi by the end of 2024. 

ARC Ride is an electric mobility or electric vehicle (EV) startup that builds electric vehicles and runs a Battery-as-a-Service business in Nairobi, Kenya.

‘’As Watu, we strongly believe that EV is the future. In recognition of the fact that coming up with the next EV for the African market is an expensive venture, we started investing in ARC Ride to help them in their research and innovation and delivery of bikes responsive to the African market to the ground, ‘’ says Erick Massawe, Kenya Country Manager at Watu.

ARC Ride’s electric motorbikes are being developed in Kenya through extensive research to ensure they meet local needs. The bikes can be operated with very low maintenance as they need no oil, chains, gears, and no fuel to operate.

Watu has consistently been dedicating resources to the development of ARC Ride with an aim to further grow the electric motorbike sector in Kenya. In addition to supporting the production of EVs, Watu is facilitating the set up of battery-swapping stations in Nairobi.

‘’For most of our riders who use their bikes for business, what they care about is being able to run a more efficient business by spending less on fuel and also having an EV that they can use without worrying that the battery will run dry in the middle of nowhere. We are helping ARC Ride set up more battery-swapping stations across Nairobi. Currently, ARC Ride has put up 76 battery-swapping stations across Nairobi and its environs, with a target of having at least 100 stations by the end of this year. This is central to making more and more boda boda riders make the switch to EVs’’ notes Eric Massawe.

The 76 swap sites are in various locations along Eastlands, Ngong Road, Githurai, Westlands, Kiambu Road, Kebete, Mombasa Road and Thika Super Highway. The battery swap stations serve at least 50 riders per day, and these numbers have been going up as the number of swap stations increase.

ARC Ride, represented by George Songe, said: “We are expanding our network of automated swapping stations to ensure that electric boda customers can conveniently replace their batteries when the need arises. Customers can replace batteries in under a minute for as low as Ksh 350 per day, for unlimited swaps.”

To make them secure and accessible, the swap stations are set up through partnerships with food chain outlets such as Dominos and Artcaffe and fuel marketing firms such as Ola Energy. A few more partnerships in the pipeline will be announced before the end of 2023.

Erick added that Watu decided to be involved in the EV development process because they’ve been exposed to the challenges that must be addressed to enable EV adoption across the continent.

The Kenyan government has prioritised the adoption of e-motorbikes into the boda boda sector, and Watu’s investment aligns with the efforts to improve access to charging infrastructure in Kenya. It will further contribute to meeting Kenya’s goal of ensuring that at least five per cent of all recently imported vehicles are fully electric by 2025, as stated in the National Climate Change Action Plan.

Andrii Volokha, General Manager for East Africa at Watu, commented: “We want to offer financing solutions that not only make access to e-motorbikes affordable to our customers and accessible nationwide. This investment will boost their penetration and uptake as we play our part to contribute to a just transition.”

Watu has been at the forefront of asset financing for two and three-wheeler vehicles.  So far, the company has financed the purchase of over 100 electric assets in Kenya.

Erick expressed his enthusiasm for the partnership, saying it will further elevate Kenya’s prospect as a leading e-mobility hub, especially for boda bodas in Africa.
